Terms of Service

1. Eligibility and Acceptance

You must be at least 18 years old (or the age of majority where you live) to use the Service.

If you use the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Account Registration and Security

You are responsible for all activity under your account and for keeping your credentials secure.

You must provide accurate account information and promptly update any changes.

We may suspend or terminate accounts that are compromised, fraudulent, abusive, or otherwise in violation of these Terms.

3. Subscriptions, Billing, and Auto-Renewal

Paid features are offered on a recurring subscription basis unless otherwise stated at checkout. By subscribing, you authorize recurring charges for the selected plan.

Prices, billing intervals, and included features are shown at purchase time and may change for future billing cycles with prior notice where required by law.

Payments are processed by third-party payment processors (including Stripe). We do not store full payment card details on our servers.

You can cancel renewal at any time through your billing portal. Cancellation stops future renewals and does not retroactively refund amounts already billed, except where required by law.

Trial and promotional offers may convert to paid plans if not canceled before the trial period ends.

4. Refunds

Fees are generally non-refundable except where required by applicable law or expressly stated in a separate written refund policy.

5. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal personal or business productivity purposes.

You may not copy, resell, reverse engineer, scrape, or otherwise exploit the Service except as permitted by law.

6. Your Content and Data

You retain ownership of content you submit to the Service, including tasks, notes, goals, and other user data ("User Content").

You grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and transmit User Content solely to operate, secure, and improve the Service.

You are solely responsible for User Content, including its legality, reliability, and accuracy.

7. AI Features and Output Disclaimer

The Service includes AI-generated suggestions, plans, and content. AI output may be inaccurate, incomplete, or unsuitable for your situation.

You are responsible for reviewing and validating AI output before relying on it. The Service is not legal, medical, mental-health, tax, investment, or other regulated professional advice.

8. Acceptable Use

You may not use the Service to:

• violate any law or third-party rights;
• upload malware, phishing content, or abusive material;
• attempt unauthorized access, disruption, or denial-of-service;
• circumvent usage limits, billing controls, or security features;
• use automated means to extract data except through approved interfaces.

9. Third-Party Services

The Service integrates with third-party providers (for example, payment processors, authentication providers, cloud infrastructure, and calendar services). Their services are governed by their own terms and policies.

We are not responsible for third-party systems, outages, or actions outside our reasonable control.

10. Intellectual Property

The Service, including software, branding, design, and content we provide (excluding your User Content), is owned by GamifiedGoals or its licensors and protected by intellectual property laws.

Feedback you provide may be used by us without restriction or compensation.

11. Termination

You may stop using the Service at any time.

We may suspend or terminate access immediately for violations, fraud, abuse, legal risk, or security concerns.

On termination, your right to use the Service ends, but provisions that by nature should survive (including payment obligations, disclaimers, limitations, indemnity, and dispute terms) remain in effect.

12. Service Availability and Changes

We may update, modify, or discontinue features at any time. We do not guarantee uninterrupted or error-free operation.

We may perform maintenance, security updates, and emergency interventions that temporarily affect availability.

13. Warranty Disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, GamifiedGoals and its affiliates, officers, employees, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, or business interruption.

To the maximum extent permitted by law, our aggregate liability for all claims relating to the Service will not exceed the greater of: (a) amounts you paid us for the Service in the 12 months before the claim, or (b) EUR 100.

Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to defend, indemnify, and hold harmless GamifiedGoals and its affiliates from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

16. Governing Law and Disputes

These Terms are governed by applicable law in the jurisdiction where GamifiedGoals is established, unless mandatory local consumer law provides otherwise.

You and GamifiedGoals agree to first attempt to resolve disputes informally by contacting us at support@gamifiedgoals.com.

If informal resolution fails, disputes will be resolved in the competent courts of the applicable jurisdiction, subject to non-waivable consumer forum rights.

17. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice by posting updated Terms, updating the effective date, and/or notifying you through the Service or email where appropriate.

Your continued use of the Service after updated Terms take effect constitutes acceptance of the updated Terms.
